The Texas Republican argued that such a designation would fundamentally damage the structure of collegiate sports, potentially leading to the collapse of popular non-revenue programs.

Cruz stated that creating a national standard is critical to avoid a patchwork of conflicting state laws, which he believes creates instability for both institutions and athletes. His position centers on preserving the traditional amateur model of college athletics, where students receive scholarships and name, image, and likeness (NIL) compensation but are not salaried employees of their schools.
